‘Is this a joke by my mates?’: The retired detective wrongly accused by NSW police

“What is this that is happening?” Harry Blackburn remembers thinking on the day a team of police came to arrest him at his workplace. “Is this a joke by my mates? It’s not my birthday!”

Indeed, it was not his birthday, and it was not a joke. The NSW police were there to arrest the 59-year-old retired detective superintendent and charge him with 25 serious offences, including rape, robbery and kidnapping over a period from 1969 to 1985.

Without the slightest idea of what they were on about, Blackburn found himself paraded in front of the media – the reports with his picture going nationally and even overseas. Without so much as a court appearance, he was branded a serial offender who had hidden for years behind his police badge. Now he was being undone by fearless police, unafraid to deal with their own.

On the day of the arrest – July 24, 1989 – the then Assistant Police Commissioner, Tony Lauer, said: “This operation has demonstrated that the NSW Police Service is more than capable of handling an extensive and highly sensitive inquiry.”

Blackburn found himself in a cell at the NSW Police Centre. Elsewhere, a police officer reportedly said: “We should slip a gun into his cell and let him blow his brains out and save the government a great deal of time and money.”

The prospective prosecution of Harry (“Harry the Hat”) Blackburn did not in fact last long. Following a change in personnel in charge of the case, diligent police officers Detective Inspector Clive Small and Detective Sergeant Ron Shaw reviewed the evidence and realised it was full of holes.

Small, against trenchant opposition from the police hierarchy, recommended the charges be dropped. They were abandoned on October 6 that year, but not before Blackburn’s wife, Lyn, devastated by the turn of events, had suffered a miscarriage.

The resulting royal commission, conducted by Justice Jack Lee, found the investigation and gathering of evidence was so clumsy and slipshod that Harry Blackburn should never have been considered a suspect. “It destroyed his life at the time,” said Clive Steirn SC, who was to represent Blackburn.

Harry James Blackburn was born in Lithgow on April 21, 1930, one of three children of a coal miner, James Blackburn, and Eileen (nee Hovey). He went to school in Lithgow and in 1947, as soon as he had turned 17, he joined the NSW Police Force, taking advantage of the fact the police commissioner was a Catholic, this being a time of reported conflict in the force between Catholics and Masons.

Blackburn began duties as a superintendent’s clerk in Goulburn, then joined the Scientific Investigation Service, where he worked for 19 years, playing rugby union for the Goulburn Waratahs. He married Norma, with whom he had children, Tracy and John. In 1970, he moved to Rockdale as a detective sergeant, followed by postings to Parramatta and Katoomba.

His marriage ended in divorce, and he married Ada. This marriage also ended in divorce. He moved on professionally and went back to police scientific work as an inspector. In 1982 he met Lyn Foster, 22 years his junior, who was a civilian employee in the NSW Police Department.

In 1985, he was promoted to superintendent and put in charge of the Physical Evidence Section, requiring him among other things to handle gun amnesties announced by the government. He was also awarded the Long Service and Good Conduct Medal. In 1987 he married Lyn.

But unknown to Blackburn, there were storm clouds gathering. There had been some savage rapes and robberies over the years, the offender usually wearing a mask and sneaking up to couples cuddling up in cars at night in lover’s lane trysts.

The first series had started in October 1969 and continued until August 1970. The second, known as the “Sutherland” series, lasted from August to December 1985. Police had obtained descriptions of one of the assailants. One happened to vaguely represent Blackburn, who then became the subject of covert police attention.

On July 14, 1988, the couple were blessed by a daughter, Holly. Blackburn retired in November that year and went to work with the War Crimes Commission. On July 24, 1989, when Lyn was three months pregnant with their second child, police swooped, and the family’s whole world was turned upside down.

The charges were laid, and Blackburn was granted bail. On August 6, Lyn had her miscarriage. On October 6, he and his wife were informed that all charges had been withdrawn. Blackburn decided not to resume with the War Crimes Commission. “The wind had been knocked out of his sails,” Lyn said.

The royal commission was held under Justice Lee, Chester Porter QC as counsel assisting, and Blackburn being ably represented by Kevin Murray QC, with Steirn as his junior. The deficiencies in the investigation soon came to light.

In December that year, Maureen, wife of Blackburn’s son, John, suffered a miscarriage. The family decided not to tell Harry just then. In April 1990, Blackburn complained that four departmental charges had been laid against him, including such things as misuse of petrol and an incident where he had thrown a jug of water over somebody, Blackburn being known to be occasionally temperamental.

He said the charges were just an attempt to discredit him, and they went nowhere. On June 29, 1990, Justice Lee handed down his report. In July, Blackburn launched proceedings against the NSW government for wrongful arrest, malicious prosecution and defamation, seeking unspecified damages.

His experience had given him a new perspective on justice, how prone the system was to misbehaviour. He was to give evidence that while sitting in his cell at the police centre on July 25, 1989, he had overheard a detective telling a prisoner that if he did not plead guilty to nine charges, he would charge him with another four.

Blackburn with his wife and child retired to Robina on the Gold Coast, and in November 1990 Blackburn got his licence as a private inquiry agent, putting a picture of a hat as his motif on his business card.

His litigation continued, a psychiatrist diagnosing him with “reactive depression”. The position of Inspector-General of the NSW Police Force was created and filled by a Canadian, Don Wilson, whose task was to “clean-up” management of the NSW Police Force, which Justice Lee had described as “lamentable”.

There would never be another bungle like Blackburn, Wilson said. The NSW government settled with Blackburn in November 1991; the agreement ratified in the Supreme Court. Blackburn, with substantial damages in his favour, did do some minor investigate work. Otherwise, he contented himself with golf, normally six days a week, looked after his wife and daughter Holly, and jogged along the beach.

Lyn went back to study and became a child psychologist. Holly did a Bachelor of International Business degree and went to work in the tertiary sector. Harry Blackburn celebrated his 93rd birthday in April, and was in good spirits’, his wife said, but then there was a sudden downturn over the following two weeks.

He died on May 9. He is survived by his widow; his three children, 10 grandchildren and two great-grandchildren. A memorial service is to be held on the Gold Coast at a time to be fixed.

Upon joining the NSWPF via the Police Cadet system, Alwyne was described thus:

6′ 1″ tall, 12 st 4 lb in weight.

He was a native of Camperdown, NSW and was single at the time.

His previous employment was that of a Truck offsider for 2 months.

Upon being Sworn In he measured at 6′ 2″ tall and was 13 stone in weight.

He was a Police Cadet for 3 years, 3.5 months.

He obtained a mark of 76.5% at the completion of Training Class 084A.

He passed his typing test on 31 March 1961 with 37 wpm.

He completed a 3 day course in Civil Defence between 13 – 15 June 1967.

He passed his Constable 1/c course on the 24 September 1963.

He failed his Sgt 3/c exams twice ( 15 May 1970 & 18 May 1973 ) but passed the exam on 16 May 1974.

He passed the Sergeants Course # 8 – Class 1 of 1978.

He married on the 29 September 1962.

He was appointed a Special Constable for the State of Victoria.

He was certified Competent to drive General Duty utes & light trucks on 8 January 1964.  He was Authorised to drive Four Wheel Drives on 10 September 1974.

“Awarded” the Australian Insignia of the Bravery Medal in recognition of his actions on 20 March 1978 when, in company with Sergeant 3/c R. L. 18 AWARDS MADE FOR BRAVE CONDUCT

Drowned rescuer earns medal

Mr Daniel Primmer, who drowned after becoming snagged in debris while trying to rescue a woman trapped by flood waters in Reedy Creek, ACT, on March 20 last year, has been awarded a Bravery Medal posthumously.

Mr Primmer was one of six people to be awarded the Bravery Medal for their part in rescuing the woman.

Altogether, 18 awards for bravery were announced yesterday by the Governor-General, Sir Zelman Cowen, on recommendations made to him by the Australian Decorations Advisory Committee. Thirteen Bravery Medals and five Commendations for Brave Conduct were awarded.

The rescue attempt at Reedy Creek took place where the stream crosses Sutton Road, near Queanbeyan.

A car driven by Mrs Rosanna Perry, 33, of Bungendore, was swept off a bridge by the flood waters.

Mr Primmer and a companion, Mr John Henjack, who also has been awarded the Bravery Medal, tied themselves with rope secured to a guide post and held by five men, and attempted to swim to the woman.

The two were swept away before they could reach her, and although Mr. Henjack was pulled to safety, Mr Primmer became snagged in debris, and drowned.

Sergeant Alwyne Hill and Senior Constable Robert Burrage, of the NSW Police, who were also involved in the rescue attempt, have been awarded Bravery Medals. With other police officers, they made three attempts to reach the stranded woman, using a rope, which failed, and then made several attempts to swim to her.

Mr Robert Perrott, of Bungendore, who also entered the flood waters but was swept away and managed to reach the bank downstream, has also been awarded the Bravery Medal.

Senior Constable Brian Bock, of the ACT Police, received a Commendation for Brave Conduct in the rescue attempt. He took charge of a NSW Emergency Service boat which eventually he manoeuvred close enough to rescue the woman.

Mr Ronald Scott, Mr Graham MacDonald and Mr Kenneth Beazley, all of Malua Bay, NSW, were each awarded a Bravery Medal for their actions during the successful rescue of three people stranded on a rocky outcrop after they had lost their boat in heavy seas.

On September 18, 1977, the three rescuers had put to sea from Guerilla Bay, and in the face of a souther’y gale reached the three people whose boat had become disabled, been washed up on the rocks and destroyed.

Mr MacDonald had jumped from the rescue boat, and persuaded the stranded people to swim to the boat, where they were all picked up and returned safely to shore.

He sat the Sgt 1/c exam twice but failed on 14 May 1974 & 13 May 1975.  He did not attain that rank.

He sat and passed his Detectives examination on the 16 – 17 October 1962.

He was certified as completing his motor vehicle drivers course on the 4 January 1956 and was also certified to ride solo Police motor cycles on the 24 November 1955.

Struck Police; Man Gaoled

Elwyn Thomas McDougall, 22, labourer, was sentenced at Newcastle Court yesterday to one month‘s imprisonment for having unlawfully assaulted Police Cadet Alan John Brown, in Newcastle on Saturday.

Constable R. Gaudion said Cadet Brown was walking along Hunter-street when McDougall and another man stepped across his path and asked him whether he wanted to fight.

Cadet Brown replied that he did not, and went to walk away, when McDougall hit him in the nose.

McDougall was arrested 15 minutes later.

The police prosecutor ( Sergeant Lithgow ) said McDougall had previous convictions for larceny and breaking, entering and stealing.

After Mr. Hardwicke, SM., had sentenced McDougall, McDougall asked the Magistrate whether he could have a fine. Mr. Hardwicke said: “Because of the way you conduct yourself in the street, you will have to learn a lesson.

On the 3 March, 1952 Brian commenced employment as a Police Cadet No.994 and this was the start of a long and distinguished career spanning 40 years with the NSW Police Force until his retirement at the age of 55 on 9 July, 1992.

Whilst training as a Police Cadet he became a competent shorthand writer (120 wpm), an efficient touch typist  (40 wpm), and a certified police rider of police motor cycle outfits (Harley Davidson and Indian models).  He obtained the Bronze Medallion and Award of Merit for lifesaving from the Australian Life Saving Society and his First Aid Certificate from the St John Ambulance Service.

At the age of l8 years he entered compulsory National Service Training with the Royal Australian Army.  Commenced on 26 April, 1955 attached to 13 National Service Training Battalion at Ingleburn for a period of 3 months and later for 2 years part time service with the 2 Div Provost (Military Police) Co., at Victoria Barracks, Paddington.   Service No. was 2/743557.

At the age of  l9 years, Brian was sworn in and attested as a probationary constable No. 8279 and stationed at Darlinghurst Police Station. He had 4 years on general duties at Darlinghurst, Vaucluse (traffic cyclist) and Braidwood.

The majority of his service was as a police prosecutor, with an intervening period of 8 years at the Metropolitan Superintendent’s Office as a Personal Assistant.  One of the many duties there was the recruitment and selection of police personnel for duty on the Island of Cyprus with the United Nations Peace Keeping Forces.

As a police prosecutor he dealt with many serious and complex matters ranging from the most simple traffic case to murder and conspiracy and drug related matters.

Brian was promoted through the ranks and received his commission on 31 December, 1985 and was later promoted to Chief Inspector in June, 1987.

In 1990  and 1991 he relieved as OIC of Redfern and Kings Cross Police Stations

On 9 July, 1991 he retired as Commander of the Legal Services Branch , South Region.

Brian was awarded the Police Long Service and Good Conduct Medal and the National Medal

Since retirement and for the past 13 years he has been actively engaged in the performance of Marriage and Funeral Ceremonies as an Authorised and Registered Civil Marriage Celebrant.  This is a very enjoyable and satisfying occupation.

Man on harbouring charge

SYDNEY: A South Australian man, described by police as a male prostitute, appeared in Sydney’s Central Court of Petty Sessions yesterday, charged with having harboured a prison escaper, Mr Raymond John Denning.

Mr Margarete Ngatai, 31, unemployed, of Para Hills, South Australia, appeared before Mr Henry, SM, wearing a maroon dress, red high-heel shoes and a bright-red-satin jacket.

He is charged with having knowingly harboured Mr Denning, an escaped prisoner, between April 6 and 21 at Nelson Bay and in Sydney.

Sergeant Brian Loomes, prosecuting, said that Mr Ngatai had accompanied Mr Denning to South Australia where they had lived together for three weeks. They had later returned to NSW.

Mr Ngatai had then returned to South Australia where he had been arrested last Wednesday. He was extradited yesterday to NSW.

Mr J. Bettons, for Mr Ngatai, said he had been told by Mr Ngatai that he had contacted police when he had discovered that the person he was living with was Mr Denning.

Mr Henry refused bail and adjourned the matter for mention to May 8.

Mr Denning is still at large.

Lotto copy swallowed, say police

SYDNEY: A man who falsely claimed for a Lotto win of $1.25 million, had swallowed the evidence – a carbon copy of the coupon – police alleged in Sydney Central Court of Petty Sessions yesterday.

Mr Rayson Light, 37, clerk, of East Sydney, was charged with having attempted to obtain $1.25 million on December 17, 1980, by having pretended he had submitted a valid winning Lotto entry.

He was also charged with having forged a Lotto coupon with intent to defraud, at Darlinghurst, on December 15 and with having uttered a forged coupon on December 17.

He was charged yesterday at Chatswood with having uttered a forged coupon. No pleas were entered.

Sergeant Brian Loomes, prosecuting, alleged that while being interviewed by detectives at Chatswood yesterday morning, Mr Light had stolen and then swallowed a carbon copy of the Lotto coupon relating to his false claim.

Mr G. Penny, for Mr Light, said the matter was still the subject of litigation in the Supreme Court.

He said his client had been born in Canton, China, and had come to Australia in 1975.

Mr R. Henry, SM, allowed him conditional bail.
