SHERIFFS attempting to evict a Warrawong man from his unit were forced to call in police when he threatened the officers with a crowbar, a court has heard.Police were forced to subdue Peter Bevan Dunn, 50, with capsicum spray when he refused to co-operate with the eviction order and repeatedly threatened to hit the officers with the crowbar if they entered the property.He was yesterday found guilty in Wollongong Local Court of hindering the sheriffs in the execution of their duties, and also assaulting a sheriff and a police officer.A further charge of assaulting a law officer was dismissed.Sheriffs Michael Riquelme and Geraldine Trimarchi went to Dunn’s Todd St unit on May 23 with an eviction notice from the Consumer, Trader and Tenancy Tribunal.
The court heard Mr Riquelme attempted to speak with Dunn through the closed screen door and explain the process, however he refused to co-operate and instead grabbed a nearby crowbar and showed it to the officers.
“He said if you do come in I will hurt you,” Ms Trimarchi said.
Mr Riquelme told the court he felt fearful and, after Dunn slammed the door shut, called police.
Four officers arrived a short time later and another attempt was made to speak with Dunn, who did not answer the door.
Dunn told the court he had been in a back room using his computer and had not heard the officers.
Lake Illawarra police officer Constable Giampiero Giuri told the court Ms Trimarchi made two attempts to kick the door open without success before he managed to kick the door open, revealing Dunn standing close by holding the crowbar above his head.
Constable Giuri said Dunn was yelling and acting aggressively and, after making several requests for him to put down the crowbar, Const Giuri pushed Ms Trimarchi out of the way before subduing Dunn with capsicum spray. He was arrested and taken to Lake Illawarra Police Station.
Dunn, an ex-police officer, said he had no intention of harming the sheriffs or police and was merely protecting his property.
He told the court he had slammed the door shut out of fear he would be tasered by the sheriffs.
Magistrate Shane McAnulty found Dunn guilty of three charges – obstructing a sheriff, assaulting a law officer and assaulting a police officer. Mr McAnulty said the assault had not involved battery but he was satisfied the victims had felt an immediate threat.

Arthur passed away on 13/02/2015 and his funeral is proposed to be held at 1pm on Wednesday 18th Instant at the West Chapel, Eastern Suburbs Crematorium, Military Road, MATRAVILLE.
All members of the NSW Police Force are advised that retired Sergeant Stephen Thomas Conroy passed away on Tuesday, 3 February 2015 aged 55 years.
Records indicate that Sergeant Conroy was performing duty at Surry Hills at the time of his retirement on 18 August 2011, completing 26 years service with NSW Police Force.
A funeral service is to be held at South Chapel, Woronora Crematorium, 121 Linden Street, Sutherland on Thursday, 12 February 2015 at 1000hr. All friends and former colleagues are invited to attend.
The Conroy family have accepted an offer of police involvement at the funeral service. The Traffic & Highway Command will provide a Guard of Honour at the chapel service.

SYDNEY, Sunday: Poisonous fumes in a sewer yesterday killed a workman and a male nurse who went down the sewer shaft to help him.
The two men were Vittorio Chiaruttini, 40, whose wife and family live in Melbourne, and Edward James Markey, 35, the male nurse.
Chiaruttini, works foreman of a sewerage scheme being installed in Hay, went down the sewer shaft and when he did not reappear his workmate went for help.
Markey, a married man with two children, volunteered to go down the sewer.
When he failed to reappear Police Constable White went down the shaft, and at the second attempt managed to get a rope around the bodies of the two men.
Two men died yesterday after being overcome by a mysterious gas which filled a narrow tunnel on a new sewerage project at Hay.
They were Victorio Chiaruttuni, 40, foreman, employed by McDonald Construction Co., and Edwin James Markey, 35, a male nurse at Hay Hospital.
Chiaruttuni entered the tunnel on a normal inspection tour and was overcome by the fumes.
Markey heard Chiaruttuni’s cries for help ; and after calling the police, entered the tunnel but was also overcome by the gas.
Constable Rex White, of Hay Police, entered the tunnel with a length of garden hose in his mouth because gas masks were unavailable.
He was semi-conscious and partly paralysed by the gas after rescuing the two men.
The three men were rushed to Hay Hospital, but Chiaruttuni and Markey failed to respond to treatment. Constable White was allowed to leave after treatment.
MILDURA, Wednesday: Police today found the body of seven-year-old Peter Philp in the River Murray.
The boy had been missing from Dareton, N.S.W., since last Friday week.
A post-mortem by the Government medical officer from Wentworth, and medical superintendent at Mildura Hospital last night revealed the boy had died by drowning.
Constables Rex White of Wentworth, and Eric Maurer of Buronga, found Peter’s body snagged against the branch of a submerged tree, about 250 yards from where his clothing was found last Sunday week.
C.I.B. headquarters said last night detectives on the case were satisfied there were no suspicious circumstances. There were no marks of violence on the body.
Peter’s disappearance set off one of the most intensive investigations ever in the area 12 miles from Mildura.
Detectives were puzzled by the fact that Peter vanished at 6.15 p.m. – only 15 minutes before he was due to meet his soldier settler father, Mr. Alf Philp, near the sweet shop the boy had just left.
XIII. Acts of Bravery by Police.
A number of Police distinguished themselves by performing acts of bravery during 1956. Brief particulars are shown

Constable Rex KeithWhite, has been awarded the British Empire Medal, as well as the Bronze Medal and Certificate of Merit of the Royal Shipwreck Relief and Humane Society in recognition of his bravery on the 7th January, 1956, in descending into an underground sewer main, then under construction at Hay.
In the first place Vittorio Chiaritina, works foremen on the job, had entered the sewer where he had been overcome by some unknown gas and collapsed. Edwin James Markey descended to the sewer in an endeavour to rescue Chiaritina, but was overcome and collapsed. Constable White was advised that the two men had collapsed and he immediately descended into the sewer, but became affected to such an extent that he could barely give the signal to be hauled up. Although practically unconscious, he was again lowered into the sewer with a garden hose in his mouth. He could not get sufficient air by this means, but although badly affected by the gas, was able to fasten a rope round Markey, and both he and Markey were hauled to the surface. A civilian named Graeme Barry Mitchell then descended and tied a rope round Chiaritina, who was brought to the surface. Mr. Mitchell has also been awarded the British Empire Medal, and the Queen’s Commendation for Brave Conduct has been conferred (posthumously) upon Markey.
