Olympics chiefs consult with activists

COMPERE: Already, the organisers in Sydney are studying today’s events at the World Trade Organisation protests in Seattle. The organisers concede it would be possible for demonstrators to disrupt access to Olympic venues next year. However Superintendent Terry Lester from Olympic security command says alternative routes have already been planned. And Superintendent Lester has been telling Raphael Epstein police are already consulting with political and activist groups liaising so there’s advance notice of demonstrations.

TERRY LESTER: Well, during Games time we obviously plan for these sort of incidents happening – not only demonstrations, but also car crashes and other incidents that may block the Olympic lanes or the CBD or other areas where a lot of people are trying to get to and from Olympic venues. Now, the way we do this is we’ve got the Olympic routes already planned out. As secondary to those, we’ve got another lot of Olympic routes where, if the first one becomes blocked, we use the alternate. We’re also trying to get people to speak to us before they demonstrate so that they can get their message across. It’s important for them to get their message across to the media, to the rest of the world, if you like, and it’s important that they do have their say.

RAPHAEL EPSTEIN: But Sydney’s already a, should we say, difficult city, traffic-wise and transport-wise. It would potentially be quite easy for them to block off the major roads leading to Olympic sites, wouldn’t it, with a couple of thousand demonstrators.

TERRY LESTER: Oh yes. And we recognise what’s happening in Seattle at the moment as to these limited number of demonstrators and effectively slowing up a major event. But working with ORTA and the RTA and the local councils, we’re trying to say to these people ‘you’ve got the right to demonstrate, we recognise that, but we’ve also got to keep the Games going at the same time’. So we’re trying to provide an alternative system, if you like, so that if one – one system does become blocked up, the alternative is there and it’s readily available to us.

RAPHAEL EPSTEIN: So if a group of demonstrators then is uncooperative, you’re going to have to rely on those back-up routes to get people into venues.

TERRY LESTER: Yes, that’s correct.

RAPHAEL EPSTEIN: How far advanced are preparations for those alternative routes?

TERRY LESTER: Oh, very much advanced. We’ve already, with ORTA, released to the public the Olympic routes where people are going – major routes which are travelling to and from the various venues around the city. There’s 11 of those. And we’ve already got secondary routes already planned out and identified – which ones – the ones that we are going to use.

RAPHAEL EPSTEIN: Would you need special powers at all to, I guess, disperse demonstrators if they are causing a real problem, if they do manage to block off all of the routes into a venue?

TERRY LESTER: No. We can use the current legislation that we already have for people causing an unreasonable obstruction – things like that, you know. And how we clear up demonstrations now is the way which we’ll do it during the Games.

RAPHAEL EPSTEIN: What do you think of the fact that tear-gas was used in Seattle this morning on the demonstrators?

TERRY LESTER: Oh, I’d rather not comment on that. I wasn’t even aware of that problem in the first place, you know. And how people police in Seattle may be totally different to the way we police here.

RAPHAEL EPSTEIN: Do you know if tear-gas has ever been used on demonstrators in Australia?

TERRY LESTER: No, I’m not aware of that. Obviously we’ve got the capsicum sprays which come out. But that’s in a reasonable life-threatening situation where enabled to use that.

You know, Australian society – the Olympic Games, you know, are melding well together. And what we’re trying to do here – it’s a friendly, open sort of a Games. But I don’t think we’re going to have serious-type demonstrations like they’re having in Seattle or with the MUA.

 A Senior Constable Lance Meline committed self harm with a police revolver at Helensburgh Police Station on the 8 April 1982.  He was apparently having trouble with hoodlums in the Helensburgh area too.

It was taken at my Passing Out Parade on 23/6/1969. It shows Adrian Allingham (R.I.P.), Dennis Gilligan, Aldo Lorenzutta (RIP) and Bruce Smith. They all won portable Olivetti typewriters as part of the Transfield trophy for topping the Detectives Course in 1968 & 1969. The little bloke without the hat was from Transfield. Bruce Smith presented his typewriter to the Detective Training Unit in 2010. Their names appear at the top of the honour board.

They all won portable Olivetti typewriters as part of the Transfield trophy for topping the Detectives Course in 1968 & 1969. The little bloke without the hat was from Transfield. Bruce Smith presented his typewriter to the Detective Training Unit in 2010. Their names appear at the top of the honour board.

Detective Sergeant Steve BALLARD attested on 17 February 1973 with the New South Wales Police Force and served in various locations across the state, including Manly ( 14 Division ) in 1974.

Family of NSW policewoman who took her own life suing state for millions

The family of a policewoman who took her own life is suing the state of New South Wales for millions of dollars, for allegedly failing to protect her from harm.

Newcastle mother-of-two Sergeant Gabrielle McDonald developed post-traumatic stress disorder (PTSD) and depression after witnessing a string of horrific incidents on the job.

She took her own life on July 3, 2013, the day after a police medical officer had declared her as fit for duty.

Her husband Andrew McDonald has filed three negligence claims against the state of NSW on behalf of himself and his two children, Jessica and Joshua.

His statement of claim, filed to the NSW District Court, said over the course of her career, McDonald attended numerous traumatic incidents, including domestic disputes, assaults, car accidents, suicides and murders.

She was particularly distressed by the drowning of a 17-year-old boy in 2009 and a double road fatality in 2010, but did not receive any counselling, debriefing or monitoring after the incidents, the statement of claim alleges.

In late 2010, she was promoted to Detective Sergeant in the Professional Standards Unit, Northern Region. But she struggled with the heavy workload, which included two stints relieving for her supervisor.

In 2012, McDonald attempted suicide in an office at the Newcastle police station, but police never investigated the incident.

“It’s investigation 101,” Mr McDonald, who was also a police officer, told the ABC.

“That’s what police do and it’s appalling that it was never done.”

Police medical officer found suicide attempt ‘was not genuine’

The day before McDonald took her own life, she was sent to see a police medical officer, Dr Naresh Verma.

Mr McDonald told the ABC, Dr Verma determined her previous suicide attempt was not genuine and he did not believe she had PTSD.

“All the staff thought well, OK, things must be on the improve, maybe Gabrielle is not sick at all, maybe she’s pulling the wool over our eyes and that was clearly wrong,” Mr McDonald said.

Dr Verma did not respond to repeated requests for comment.

The police force determined that McDonald should be transferred to another police station the next day.

According to the statement of claim, she was summoned to a meeting without warning and without a support person to be told she was being moved.

McDonald left the meeting in a distressed state, drove to a state forest and took her life.

Mr McDonald said he had one last telephone conversation with his wife.

“She said I can’t go on any more. I’m not getting better. I’m such a burden. They keep kicking me down at work. All I’m trying to do is keep my hours up. You know, this is hopeless,” he said.

“And I said: ‘You can’t do this’. I pleaded with her and begged her not to.

“She said I love you and the kids. We talked about all the things we’d done together, but nothing I said would make sense to her, she was just that determined to do it”.

McDonald ‘did not receive proper monitoring’

Mr McDonald’s lawyers allege that the police service ought to have known the meeting would cause her distress and that she was at risk of self harm.

They allege the NSW police force was negligent because it failed to maintain a safe system of work to avoid injury to McDonald.

It had also allegedly failed to provide her with adequate training to perform her duties and to take precautions for her safety, “putting her in a position of peril”.

The service is also accused of failing to provide adequate training on how to recognise the symptoms of psychiatric injury.

“The deceased did not receive any or proper monitoring of her condition while she continued to work in a stressful environment,” the claim states.

The claim also alleges the police force had failed to devise a system for the flagging of police officers involved in numerous distressing or traumatic incidents.

As a result of its negligence, McDonald had suffered a major depressive disorder, chronic PTSD, alcohol abuse and death by suicide, it is alleged.

Mr McDonald said he now suffered from an adjustment disorder with depression and anxiety.

He was on track to become a superintendent, before he was medically retired.

He is claiming about $900,000 in future lost earnings, in addition to damages and interest. He is also seeking damages on behalf of his two children.

Damages are limited to $750,000 in the NSW District Court, but it does have the discretion to lift the cap.

In a statement to the ABC, the NSW police force said it could not comment specifically on the tragic circumstances which led to the death of a serving officer.

“NSW police continues to improve its practices and procedures, having made significant advances over many years to minimise the psychological impact of policing duties on our officers, who frequently undertake stressful and difficult work,” the statement said.

“As a major priority, NSW police encourages the reporting of these impacts and offers a range of services to support, guide and educate our staff.

“These support services are comprehensive and effective.

“It is well understood that every officer’s circumstances are unique and most often extremely complex with regard to the impacts of psychological injury.”

Gabby was from the Eggleston family of the Hunter & loved horses and racing. She taught riding to kids with patience & care. Gabby also helped place horses with the Mounted Section NSW Police.
Along with Gabby & Deb Hayton, we had a tough feminine perspective to our office in the 90’s.
Sad to know when she was in need, Gabby felt alone.

About 5.30pm on 27 March, 2002 the constable was driving an unmarked Highway Patrol vehicle when he began to follow a stolen vehicle. In Denison Street, Hillsdale the vehicle sped off and Constable McEnallay informed VKG of the pursuit. The stolen vehicle turned into Grace Campbell Crescent and stopped. As the police vehicle came to a halt near the stolen vehicle four offenders alighted from it and fired a number of shots at the constable from a distance of about three metres. Constable McEnallay was hit in the right side of the head and right shoulder. Other police arrived at the scene and two offenders were arrested. Constable McEnallay died of his wounds on 3 April, 2002. He was posthumously awarded the Commissioner’s Valour Award.

A MAN involved in the murder of Sydney policeman Glenn McEnallay was today refused parole.

Motekiai Taufahema, 35, is serving 11 years jail after being found guilty of Senior Constable McEnally’s manslaughter.

His bid for freedom was today rejected by the State Parole Authority.

He was one of four men convicted for the shooting murder of Constable McEnallay ten years ago.

The State Parole Authority said today they believed Taufahema has not addressed his offending behaviour and his release is not supported by the Serious Offenders Review Council (SORC).

His seven year non-parole period ended last month.

“The offender needs to be reduced in classification before progress and judgment … It is not appropriate for SPA to consider the offender for release on parole.”

Commissioner Ron Woodham opposed Taufahema’s release, saying it was not in the public interest and he had not addressed his offending behaviour.

Taufahema, found not guilty of the murder of Senior Constable McEnallay but guilty of manslaughter, was sentenced to 11 years prison.

Motekiai’s brother, John, also found not guilty of the murder of Senior Constable McEnallay but guilty of manslaughter, was last month refused parole and will not be eligible again until 2014. His full sentence is also 11 years with a non-parole period of seven years.

The Authority last month also refused parole for co-offender Meli Lagi at a private meeting. He will not be eligible for parole again until next year.

Lagi, 32, who was found not guilty of the murder of Senior Constable McEnallay but guilty of firearms offences, was sentenced to almost 13 years prison with a non-parole period of almost nine years, which expired on 2 April 2011.

The fourth co-offender, 32-year-old Sione Penisini, is serving a total sentence of 36 years and won’t be eligible for parole until 2029.

Court allows police killer to stay for daughter’s sake

ONE of the men jailed for manslaughter over the death of Senior Constable Glenn McEnallay has escaped deportation to Tonga even though he has spent more than half of his 21 years in Australia in prison.

The best interests of Motekiai Taufahema’s seven-year-old daughter, born after he was jailed, tipped the balance in his favour when he appealed against the cancellation of his visa. But his childless brother, Sione, 31, also convicted of McEnallay‘s manslaughter, will be sent back to the country he left aged nine.

A victims’ group says the decisions perversely reward criminals who become parents, while refugee advocates say they show the unfairness of the Migration Act’s ”character test”.

Although Motekiai Taufahema, 33, had spent 12 of 21 years here behind bars, the deputy president of the Administrative Appeals Tribunal, Robin Handley, found his daughter ”loves her father and misses him” and would be devastated if he were deported.

Combined with evidence of his rehabilitation, including a non-violent response to being stabbed 10 times by a fellow prisoner, it earned him ”one last chance”.

Mr Handley rejected Sione Taufahema’s appeal on the same day, saying the high risk of him re-offending outweighed other factors. Noting that he has spent almost 10 of his 21 years here in prison, Mr Handley accepted the Federal Government’s argument that the community would expect to be protected against his violent criminal behaviour.

Asked about Sione Taufahema’s imminent arrival, a Tongan Government spokesman said in an email, ”No comment.”

The Taufahema brothers were both on parole for a brutal bashing when stopped with four stolen guns in Hillsdale in 2002. Their accomplice, Sione Penisini, shot McEnallay four times.

Both brothers were sentenced to 11 years jail after pleading guilty to manslaughter – a result McEnallay‘s father, Bob, called a ”bloody disgrace”.

Sione Taufahema‘s deportation adds to a turbulent few years for the Taufahema family. Two of his siblings, Honora and Filisione, are also in jail. Another, 18-year-old Tavita, was shot dead by police in September during an armed hold-up at the Canley Heights Hotel. Last year 16-year-old Chris Emmerson was shot dead by a visitor at the family’s Yennora home.

The father, Maunaloa Taufahema, said he was happy for Motekiai’s daughter but disappointed for Sione, whom he considered Australian, not Tongan.

”He has spent a lot of his life in Australia, and to me his behaviour was based on the Australian environment,” he said.

Both brothers have spent only a week or two in Tonga since they left as children and their close families have since moved to Australia and New Zealand.

Robyn Cotterell-Jones, from the Victims of Crime Assistance League, said both brothers should be deported as a deterrent. ”I imagine victims would feel it’s wrong that if you’re arrested for murder but you get somebody pregnant you will be able to stay here rather than be deported.”

Dr Michael Grewcock, an expert on the character test from the University of NSW, said it seemed bizarre to deport one brother and not another: ”There’s just a general lack of consistency, which is built into the process.”
